Conditions for re-use of public sector information
The principles and modalities of disclosing public sector information and transferring it for re-use are defined by the Open Data and Re-use of Public Sector Information Act [1].
Spatial information of the Warsaw City Council is made available for re-use:
1. on the website of the Warsaw City Council: um.warszawa.pl,
2. in the mapping service of the Warsaw City Council: mapa.um.warszawa.pl,
3. on the addresses and streets Internet services: adresy.um.warszawa.pl and ulice.um.warszawa.pl,
4. through the following services:
· WMS (Web Map Service) – https://wms.um.warszawa.pl/serwis,
· WFS (Web Feature Service) – https://wfs.um.warszawa.pl/serwis and https://wms2.um.warszawa.pl/geoserver/wfs/wfs,

Conditions for re-use of public sector information
1. The re-use of public sector information, for whatever purpose, is free of charge.
This does not apply to:
a) data from the district geodetic and cartographic resource, which includes:
· the land and building register database (EGiB),
· the geodetic land utility network registry database (GESUT),
· topographic objects database (BDOT500),
· soil classification of land,
· property price register,
· detailed geodetic grid for the district area,
· orthophotomaps and photomaps.
No fees are charged for:
· cadastral plots as regards their identifiers and geometry,
· buildings in terms of their identifiers, geometry and type,
· detailed geodetic network,
· orthophotomaps.
Details of the fee exemption are described in the Geodetic and Cartographic Law [2].
b) where we will have to incur additional costs to prepare the data as indicated in the application. In this situation we can:
· charge a fee, the amount of which may not exceed the sum of the costs directly incurred for the preparation or transmission of the information;
· refuse access to data if the preparation of such data in the requested manner requires additional work beyond that of a simple operations.
2. The data presented in the map portal originate from:
a) the resources of the City of Warsaw,
b) other public entities,
c) non-public entities,
d) the central geodetic and cartographic resource - orthophotomaps,

e) the National Archives in Warsaw:
· Lindley plans at 1:250 scale,
· Lindley's plans in 1:2500 scale (stored in complex 72/1001 of the Sewerage and Waterworks Construction Board in Warsaw, ref. 785),
· Plan of Warsaw Fortifications 1831 (held in archival complex 72/1004 Collection of maps and plans of Warsaw, ref., K I 37 - [Warsaw city and fortifications plan] [Plan of the Engineers Corps], 1831,

3. Anyone who uses the data of the Warsaw City Office for any purpose whatsoever, should:
a) inform of the source of data by indicating the full name of the Warsaw City Office or the abbreviated name (PL- – Urząd m.st. Warszawy),
b) inform of the time of data creation, i.e. how up-to-date the data is,
c) inform of the time of obtaining the data from the Warsaw City Office,
d) inform on the surname, first name or pseudonym of the creator or performer, if the author is mentioned in the materials from Warsaw City Office, where the information:
· has the characteristics of a work or is covered by related rights within the meaning of the Copyright and Related Rights Act [3],
· constitutes a database within the meaning of the Act on the Protection of Databases [4],
e) inform the Warsaw City Office via e-mail at

about any processing of the provide data,
f) inform downstream recipients of the processed data that the source data have been modified and indicate the extent of the modifications,
g) use the data in a way that does not interfere with other users' access - if we find such interference, we may restrict, interrupt or even block access to the data.
4. Responsibilities of the Warsaw City Office for the disclosed or transmitted information:
a) some of the information on our website and services may be out of date or contain errors - we are not liable for any damages arising from the use of these resources,
b) we are not responsible for:
· use of the data in a manner contrary to the law,
· the use of data or databases by users in excess of their rights,
· further sharing of re-used information,
c) the possibility of using works or databases for any purpose is subject to the provisions of the Copyright and Related Rights Act [3] and the Database Protection Act [4], subject to the rights of third parties,
d) the site includes scanned maps and plans, their original scale of development, accuracy and detail of drawing may significantly differ from the scale and accuracy of drawing of cadastral plots and other presented contents,
e) the appropriate scale for interpreting the content of a scanned map or plan is the scale of the source document, old maps and plans, due to paper deformation, may have distortions preventing their precise superimposition on the content of the map, the superimposition of drawings is only indicative,
f) The maps presented on the map portal can be used at your own risk,
g) the possibility of using maps and spatial data in legal or administrative proceedings is a matter for the competent authority to assess,
h) information in the address and street services of the City of Warsaw contain address and naming data - they are up-to-date as of the date of publication on the site,
i) data from the register of localities, streets and addresses are updated and made available according to the Regulation on the register of localities, streets and addresses [5],
j) the data of the district geodetic and cartographic resource are acquired and updated according to the rules provided for this resource [6],
5. The Warsaw City Mayor, by way of a decision, may refuse to consent to the re-use of public sector information.
A decision to refuse permission to re-use public sector information may be appealed to the minister responsible for information technology within 14 days of receipt.
6. The principles described apply to all entities (including those that carry out public tasks), if the purpose of using the information goes beyond their tasks.
